Your General Responsibility

Under the Foothills Rental Store contract, you assume full responsibility for the loss or destruction of, or damage to, the equipment while in your possession or control, or while in transit to or from any place of use or storage. You agree to pay to Foothills Rental Store in cash the full value of the equipment in the event the equipment is lost or destroyed, or for the full cost of repairs if it is damaged.
You also agree to assume full responsibility for all personal injuries or property damage arising out of your use and possession of the equipment, and to defend, indemnify and hold Foothills Rental Store harmless for any liability for any such personal injuries and property damage.

Damage Waiver

As an added service, we have a mandatory damage waiver charge of 10% of the gross rental charge. In return, Foothills Rental Store waives your responsibility for accidental damage to the equipment while in your possession and control. You must still take reasonable precautions to protect the equipment and not intentionally damage the equipment.

Damage Waiver Exceptions

Even with the Damage Waiver, damage or loss caused by burglary, theft, conversion, misuse, abuse intentional or negligent damage or destruction, or similar causes remain your responsibility including without limitation:

1) Use or operation of equipment in a manner inconsistent with the manufacturers instructions, or contrary to the rental contract.
2) Loss or damage to accessory equipment such as welding leads, electric cords, bits, batteries, hoses, tires, tubes or harness, etc.
3) loss due to inventory shortage, wrongful conversion or any dishonest act by customer or by a person entrusted by customer with the equipment, including customers employees, sub-contractors or agents.
4) Loss or damage due to flood, storm, earthquake or other external factors.
5) Loss or damage due to overloading or exceeding rated capacity, misuse, abuse, or improper servicing of the equipment.
6) Seizure or destruction of the equipment by order of the government authority.
7) All loss or damage of equipment caused by theft, vandalism, or malicious mischief.

Equipment Value and Repair Costs

Cost of repairs shall be determined by Foothills Rental Store and the manner in which they will be repaired shall be determined by Foothills Rental Store. Full value at the time of any loss or destruction shall mean the manufacturer's list price to Foothills Rental Store. The equipment shall be deemed destroyed if the cost of repairs exceeds the manufacturer's list price and equipment shall be deemed lost, if the customer is unable to recover the equipment for the period of 30 consecutive days. You agree that your liability for the rentals for any lost, damaged or destroyed equipment shall continue until Foothills Rental Store has been paid in full for damage as mentioned above.

Theft and Vandalism

In the event of theft or damage to the equipment as a result of vandalism or malicious mischief, in addition to your responsibility for payment of the replacement cost, you are required to submit to Foothills Rental Store a police report within 10 days of the event.

DAMAGE WAIVER IS NOT INSURANCE

Damage waiver is NOT Insurance, You are still responsible for all personal injuries or property damage as set forth in the Rental Contract or operation of the equipment. The Damage Waiver is Enforced For the Same Duration as the Rental Period. A Rental Period Begins When You Pick up the rented equipment and ends when the rented item is returned.

Note: This guide is intended to summarize your obligations under the rental contract, In the event of inconsistency between this guide and the terms and conditions of the Rental Contract, the terms and conditions of the Rental Contract shall govern.
